Information for Owners

At the time a purchaser takes title to a property that is part of either the broader Cascades at Yallambie Estate or the Cascades View development, they agree to become a member of the Cascades at Yallambie Home Owners' Association Incorporated. Residents of Cascades View additionally become members of the Cascades View Owners' Corporation.

Caveat

The Association will, following settlement, place a caveat on the owner's title to protect the Association in respect of payment of fees for the maintenance of common areas, due quarterly. Owners must be aware -

 

If selling: 
To advise their lawyer or conveyancer of the operation of the Home Owners' Association, that the purchaser must become a member of the Association (this will need to be included in the contract as a special condition) and of the fee payable to the Association (which needs to be included as an outgoing in the Section 32 Statement).

If refinancing:
Generally a new lender will require the Association's caveat to be removed and a new caveat to be established following the mortgage. A priority agreement can be given whereby the mortgagee has first interest in the Title, in which case no legal fees are incurred by the owner.

Costs of the Association in respect to lodging caveats over titles and withdrawing those caveats upon sale or refinancing are the Owner's responsibility.
